Having a Divorce from Azerbaijan Recognised in Germany

If you were divorced in Azerbaijan and want to remarry in Germany or have your marital status registered, you will in many cases need formal recognition of the divorce. The competent body is the Landesjustizverwaltung (state justice administration) of the federal state in which one of the spouses has their habitual residence (§ 107 FamFG). For the procedure, the Azerbaijani documents must be submitted with a translation by a translator authorised in Germany.

When is recognition necessary?

Foreign decisions in matrimonial matters are only recognised in Germany once the state justice administration has established that the requirements are met. An exception applies if a court or authority of the state of which both spouses were nationals at the time of the decision made the decision. Whether this exception applies in your case can be clarified by the registry office or the state justice administration.

Which documents are required?

The exact list is set by the competent federal state. Frequently required are:

  • Application form of the state justice administration
  • Marriage certificate or certificate of marriage
  • Divorce judgment or divorce certificate with a certificate of finality
  • Identity documents of the spouses
  • Translations of all Azerbaijani documents

Who may translate the documents?

As a rule, a translation by a translator publicly appointed, sworn or authorised in Germany is required. As a translator for Azerbaijani generally authorised by the President of the Landgericht Frankfurt am Main (Regional Court), I produce such translations; they are recognised in all German federal states.

Legalisation or apostille?

Depending on the authority, documents from Azerbaijan require either legalisation or an apostille. Clarify this with the state justice administration before applying, so that you do not have to obtain the originals twice.

How to proceed

  • Request the current list of documents from the state justice administration of your federal state
  • Obtain the originals from Azerbaijan and clarify whether legalisation or an apostille is required
  • Send me the documents as a scan: you will receive a quote with the price and delivery date
  • Submit the application with the originals and certified translations

Frequently asked questions

Where do I apply for recognition?

To the state justice administration of the federal state in which one of the spouses has their habitual residence. In many states this is the President of the Oberlandesgericht (Higher Regional Court). The registry office will tell you which office is responsible.

Does the translation have to be produced in my federal state?

No. Translations by a translator authorised by a court in Germany are recognised in all federal states.

How much does it cost to translate a divorce judgment?

That depends on the length of the judgment. Send me a scan and you will receive a binding price.
